The Ohio Supreme Court on Wednesday suspended Jon Ickes, a Sandusky County Common Pleas judge, from the practice of law for two years, and in the same order suspended him from judicial office without pay for as long as that runs.
He was not removed, and the distinction is not a quibble. The coverage has not been consistent: the court’s own news service headlined it a removal from office, one Toledo station said the court removed him, and a third reported a two-year suspension without mentioning the bench at all. The order suspends him from judicial office under the rule that governs judges, which is not the same as removing him from it. It matters for one reason: his term runs to Dec. 31, and his name is already on the Nov. 3 ballot for the next one.
At the center of the case is a conflict the court called glaring. Ickes presided over cases his own stepson investigated — Fremont officer Christian Ortolani — without disclosing the relationship or asking anyone to waive it. In one, jurors were asked whether they were related to any state witness while the judge said nothing about being related to one. Both convictions came apart: the Sixth District reversed an assault conviction for an unconstitutional potential for bias, and vacated a second — the livestreamed rape of an 18-month-old — on due-process grounds. That defendant was retried and resentenced Feb. 4 to the term he already had, life without parole.
The rest of the record is a workplace. For the eight months the child-rape case sat on his docket, the court found, Ickes referred to it as the “baby cocksucker case.” He texted three staff mocking a man in the gallery during jury selection, and as the crime video was described in testimony sent them a clip of a woman eating a banana. He told his assignment commissioner — pregnant, and having asked him to stop — to “wait until the titty fairy comes,” then had his wife call her after she complained. She transferred to the county’s other judge, Jeremiah Ray, who reported him. He quoted a film line with a racial slur within earshot of a Black defendant. He kept a Nerf gun in chambers and shot people with it, defendants included, and once opened the drawer with his firearm instead.
The board that heard the case recommended one year, fully stayed — no time off the bench. The court imposed two years he will serve; two justices dissented for less. Kennedy answered the board directly: ordinary lawyers who commit only some of these violations serve their suspensions, and a judge with more of them “should be more, not less, severe.”La junta que oyó el caso recomendó un año, totalmente en suspenso — sin tiempo fuera del estrado.
Then the ballot. Ickes runs Nov. 3 for a term beginning Jan. 1 he would spend mostly suspended; no Republican or Democrat filed against him in May. His opponent, Kimberly Ontko, is a Fremont attorney running as an independent — and a magistrate in the same courthouse, assigned to Judge Ray. Whether his name stays on the ballot is now with the county prosecutor, Beth Tischler, who testified for Ickes at his hearing and rated him a nine out of ten as a trial judge. She had issued no opinion as of Wednesday.
Three things this paper could not establish: whether the seat is legally vacant, who is hearing his cases, and what Ickes says about any of it. He could not be reached, and nothing has come through counsel.
