He testified that he thrust the gun toward Kayda Valone’s face, and denied he ever tried to pull the trigger, saying he wanted only to force the sale of the Traverse City house the two had owned so he could collect his share.
“He was not there for a relationship-building effort,” Mock said. “When you fire a deadly weapon, or attempt to fire a deadly weapon, in a public place, you put everyone’s lives at risk.” A moment later she told the jury that when a person points a loaded gun at someone, he knows what he is doing. Exton smiled and gave a thumbs-up.
His lawyer, Ronnie Wingate, had conceded the act in his opening statement, before a witness was called, and argued the law instead: “Attempted murder requires that a substantial step has to be taken in order to constitute the act of attempted murder.” The jury did not accept it.
Exton was removed after he interrupted Mike Loisel, the chief of special prosecutions, over a 2024 voicemail he left for Valone. Loisel read the line as “Sooner or later, I gotta cut you down.” Exton broke in to say the words were “Sooner or later, God’ll cut you down,” which is the Johnny Cash line. He then shouted a string that included claims to be God and the Anti-Christ, praise of Satan, a slur he applied to himself, and the word “gun” repeated. Cook instructed the jury that none of the interruptions were to count against him.
The night at Sabira
It was the restaurant’s opening night, April 11, 2025, at 139 S. Huron St. The staff had rehearsed and worked through soft openings, and the room was full.
Exton came in once, alone, and sat at the bar. Aaron Henderson, the bartender, served him a single bourbon and thought he seemed “on edge, not very friendly, irritable, nervous almost.” Exton ordered a round sent to the Valones’ table, spat in its direction, missed, and left. Henderson never delivered the drink. He told his manager instead. About 20 minutes later Exton came back, and Kori Williams, working the host stand, said he “entered like he had a plan.”
Kayda Valone saw him coming the second time and started the video recorder on her phone, propping it against the table. “I yelled ‘Gun!’ over and over again because I knew I was dead, and I didn’t want anyone else to get hurt,” she testified. The gun was aimed at her face, she said, and she watched his expression turn to frustration when it did not fire. It did not fire because the safety was engaged.
Tracy Cole, Jr., the waiter serving that table, took him from behind. “I didn’t want her to die,” he told the jury. “I tackled him, but he’s bigger than me, so he kind of fell on me, and I just grabbed the gun and tried to hold it with my hand over it.” Asked what he had been trying to do, Cole said: “Not die.” He got the gun away and handed it to police. Jeanne Valone testified she had been “absolutely, 100-percent sure the three of us were going to die.”
From the stand on Thursday, Exton asked prosecutors to charge Cole with attempted murder, because Cole had testified he briefly considered shooting him. Cole was never shown to have pointed the gun at anyone.
How it took 17 months
Exton first pleaded not guilty by reason of insanity. He was found competent to stand trial twice, the second time after he replaced his appointed lawyer with one he hired, and the psychological report from that second round did not reach the court until May 2026. On May 12, 2026, Cook ruled that he had not had a severe mental defect at the time and denied the insanity defense. That ruling is the reason this week’s trial was an argument about intent rather than about sanity. A July trial date slipped to Aug. 31 after scheduling conflicts and a death in his lawyer’s family.
Who Matthew Exton is
Exton is 43, and until 16 months before the night at the restaurant he was a prosecutor. He took his law degree at the University of Toledo in 2008, was admitted to the Ohio bar that year and to Michigan’s in 2022, and practiced family law, criminal defense and probate work.
He was chief assistant prosecutor of Kalkaska County, Mich., for about six weeks, ending Feb. 21, 2024. The day before that job ended he went to the Cabela’s store in Dundee, Mich., in Monroe County, and tried to buy a handgun using a prosecutor’s identification card that lacked a state law-enforcement number. Staff refused. He came back about two hours later, loaded a round from ammunition he had bought on the first visit and produced a gun of his own, and a manager called 911. Kalkaska County Prosecutor Ryan Ziegler fired him within days and would not say why. That September, Exton pleaded no contest to a misdemeanor, illegally transporting a loaded firearm in a motor vehicle, and paid a $500 fine.
The Ohio Supreme Court suspended his law license on May 6, 2025, five days after the Toledo Bar Association asked it to on the ground that he posed a substantial threat of serious harm to the public. He filed no response. That suspension was an interim one, held open pending the criminal case. The criminal case is now decided.

That review flagged 52 more buildings. The department has not said what the anomalies are at any school, and said they turned up in both traditional public schools and community schools. Adam Schira, a lawyer at Dickinson Wright representing SunBridge and Toledo Prep, said in a statement: “We are eager to assess the anomalies and resolve any concerns in full cooperation with the department.” Administrators at Rise & Shine could not be reached Friday. The investigation is continuing.

Go out at 11:30 tonight, face south-southeast, and look lower than feels right. Most of the sky’s bright stars are overhead or in the west. This one is barely above the rooftops, about 13 degrees up, alone in a wide dark stretch of sky with nothing else of its brightness anywhere near it. That is Fomalhaut, the mouth of the fish, the brightest star of Piscis Austrinus, the southern fish. The old sky-watchers called it the Lonely One, for exactly the reason you are about to see.
If you cannot find it, use the Great Square of Pegasus, high to its upper left: four stars in a slightly tilted box, the plainest shape in the autumn sky. Markab, the Square’s lower western corner, sits almost due north of Fomalhaut on the same line through the sky. Come down from Markab and keep going until you are nearly out of sky. Fomalhaut is the one star waiting there.
It is 25 light-years off, which makes it a close neighbor, and from this latitude it never climbs higher than about 19 degrees. It reaches that around 1:35 in the morning and then starts down again. Everything in front of it works against you: the haze that sits over the lake, the city’s own light piled up along the horizon, a garage roof, a tree.
Tonight the one thing not working against you is the Moon, which does not rise until 12:20. Until then the sky is as dark as it gets here. Take the low star first.
Salga esta noche a las 11:30, mírese al sursureste y busque más abajo de lo que parece razonable. Casi todas las estrellas brillantes están en lo alto o al oeste. Esta apenas asoma sobre los tejados, a unos 13 grados de altura, sola en un tramo ancho y oscuro de cielo sin nada de su brillo cerca. Es Fomalhaut, la boca del pez, la estrella más brillante de Piscis Austrinus, el pez austral. Los antiguos observadores la llamaban la Solitaria, justo por lo que usted está a punto de ver.
Si no la encuentra, use el Gran Cuadrado de Pegaso, en lo alto a su izquierda: cuatro estrellas en una caja algo inclinada, la figura más sencilla del cielo de otoño. Markab, la esquina occidental baja del Cuadrado, queda casi justo al norte de Fomalhaut, sobre la misma línea del cielo. Baje desde Markab y siga hasta casi quedarse sin cielo. Fomalhaut es la única estrella que espera ahí.
Está a 25 años luz, lo que la convierte en una vecina cercana, y desde esta latitud nunca sube más de unos 19 grados. Llega a esa altura hacia la 1:35 de la madrugada y después vuelve a bajar. Todo lo que hay delante juega en contra: la bruma sobre el lago, la propia luz de la ciudad amontonada en el horizonte, el techo de un garaje, un árbol.
Esta noche lo único que no juega en contra es la Luna, que no sale hasta las 12:20. Hasta entonces el cielo está todo lo oscuro que aquí llega a estar. Empiece por la estrella baja.
