The proclamation that paused it, signed Aug. 18, sets the moment exactly: “12:01 a.m. eastern time on August 22, 2026.” This paper reported the deadline Wednesday as the end of the day Friday. The three proclamations of July 20, published July 23 at 91 FR 46663, are the first use of Section 338 of the Tariff Act of 1930 in the 96 years it has been on the books. Proclamation 11048 covers motor vehicles, 439 tariff subheadings. Proclamation 11046 covers alcoholic beverages, 63 subheadings. Proclamation 11047 covers dairy, 52. Origination under the United States-Mexico-Canada Agreement does not exempt a good. Where the talks stood at last light: Canada’s trade minister, Dominic LeBlanc, and the U.S. trade representative, Jamieson Greer, met for three hours in Washington on Thursday against a scheduled 30 minutes. LeBlanc said the two sides were “very close.” Greer left just after 7 p.m. and, asked whether there was a deal, said, “No comments this evening.” Canada’s chief negotiator, Janice Charette, stayed in the building. Every reported term of a deal — steel and aluminum cut from 50% to 25% under quota, vehicles from 25% to 15%, a change in how Canada allocates dairy import licenses — comes from unnamed sources, and all of it concerns Section 232 tariffs. The Gordie Howe International Bridge took 41,100 inbound crossings in its first five days, including 4,100 commercial trucks entering Canada; over the same period the Ambassador Bridge and the Detroit-Windsor Tunnel together took 52,700. What this paper could not establish, after looking twice in three days: any dated statement on this deadline from the Toledo Regional Chamber of Commerce, the UAW, Stellantis, or a named Toledo-area employer. The Detroit Regional Chamber’s MichAuto tariff statement, still posted, is dated April 3, 2025 and concerns a different set of tariffs. Sandy K. Baruah, the chamber’s president, gave a four-and-a-half-minute interview on Michigan and Canada that aired Aug. 19; it was published as audio without a transcript, so no words of his are printed here. THE ALMANACEL ALMANAQUE Section 338 sits inside the Tariff Act of 1930 — the law the country generally remembers as Smoot-Hawley. It lets a president put new or additional duties on a country he finds is discriminating against American commerce, and unlike most trade authority it requires no investigation and no injury finding.
